Sigma Computing, Inc., its subsidiaries, and its affiliates (collectively “Sigma”, “we”, “our” or “us”) are committed to protecting your information. This Sigma Privacy Notice (“Privacy Notice”) describes how we process your Personal Data in the general course of our business, as described in Section 1, and the rights and choices you have related to our processing of your Personal Data.

As used in this Notice, “Personal Data”, means information that identifies, relates to, describes, or could reasonably be linked or associated, directly or indirectly, with you.

If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to provide you with additional information regarding your rights with respect to your “personal information”. This information is described in our Supplemental Notice to California Residents.

1. Applicability of This Privacy Notice.

1.1 Applicability

This Privacy Notice applies to Personal Data collected and processed by Sigma as a controller, generally in the course of its business, including when you

(a) use, visit, or interact with our websites that link to this Privacy Notice, including sigmacomputing.com, help.sigmacomputing.com, community.sigmacomputing.com, support.sigmacomputing.com and quickstarts.sigmacomputing.com (collectively the “Sites”);

(b) you register for, attend, or participate in our events, webinars, programs, summits, demonstrations, conferences, trade shows, seminars, or other events (whether virtual or in-person), as supplemented by our Events Privacy Notice (“Events”);

(c) create an account at or otherwise interact with our support or customer service at support.sigmacomputing.com;

(d) communicate or interact with us (e.g., through emails, phone calls, texts, our AI chatbots), including submitting support and service requests;

(e) participate in free trials; or

(f) participate in surveys, research, or other similar data collection facilitated by us.

1.2 Sigma’s Offerings

Sigma is the owner and provider of a cloud-based intelligence platform and other related services (collectively “Services”). A separate agreement with customers governs the delivery, access and use of Sigma’s Services (the “Customer Agreement”), including Sigma’s processing Customers’ and their authorized users’ Personal Data. The organization (e.g., your employer) that enters into the Customer Agreement (“Customer”) controls its Instance of the Services (“Instance”). Customers designate which of their personnel, agents, or clients (if permitted by their subscription) are authorized to use a Customer’s Instance (“Authorized Users”). Please note:

(a) This Privacy Notice does not apply to Sigma’s processing of Customer or Authorized Users’ Personal Data as a processor on behalf of the Customer, including Personal Data that is within a Customer’s data warehouse, or is otherwise uploaded, input, or provided by a Customer or Authorized Users when using the Services (collectively “Customer Data”). If you are an Authorized User, please review Section 12 (Notice to Authorized Users).

(b) If you have received an invitation to join an Instance to use the Services as an Authorized User, this Notice will apply to Sigma’s processing of your Personal Data, to the extent required to allow you to create an account and join the Customer Instance, as described Section 2.

1.3 Third-Party Services

This Privacy Notice only describes Sigma’s processing activities and does not apply to any of the processing activities of a third-party, including processing by third-party applications or software that integrates with Sigma’s Services. This Privacy Notice does not apply to, and we are not responsible for, the practices of any third parties, which have their own rules for how they collect and use your Personal Data. Links to third-party websites or services on our Sites are not endorsements.

1.4 Employee, Vendor, and Candidate Personal Data

This Privacy Notice does not apply to Sigma’s processing of the following types of Personal Data:

(a) Personal Data processed for the maintenance and facilitation of relationships with Sigma’s vendors, suppliers, service providers or the employees of such entities (“Vendors”). Such processing is subject to separate agreements between Sigma and Vendors;

(b) Personal Data of Sigma’s employees, interns, or contractors (“Employees”) processed during their employment or other contractual relationship with Sigma. Such processing is subject to Sigma’s Employee Privacy Notice, made available to all Sigma Employees in Sigma’s employee handbooks.

(c) Personal Data about job applicants, and other individuals who apply for jobs with Sigma or otherwise engage with Sigma’s recruitment and hiring processes (“Candidates”). Such processing is covered by Sigma’s Candidate Privacy Notice made available to Candidates through our job application portals.

1.5 Applicable Laws

Sigma’s processing of Personal Data is in all cases subject to the requirements of applicable national, federal, state, and local laws. To the extent this Privacy Notice conflicts with applicable laws in your location, the applicable law in your location will control.

2. Personal Data We Collect

2.1 Types of Personal Data We Collect.

We may collect and process the following types of Personal Data, generally in the course of our business, including when you visit or interact with our Sites:

  • Contact Data, which includes your name, email address, phone number, company name, professional/job title, and country/region;
  • Technical Data, which includes internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-ins and versions, operating system and platform, device IDs, MAC addresses, referring/exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information. We may also use your IP address to derive your general location information;
  • Usage Data, such as information about how you interact with and use our Sites, including preferences on how your content is displayed, safe search settings, and favorite widgets. Usage Data is automatically collected when you access, use, or visit our Sites. We may associate this Usage Data with other data we collect (e.g., your device ID, IP address etc.) and you can edit these preferences at any time;
  • Location Data, which refers to your general location information that we infer from other information we collect from and about you (e.g., your IP address). We do not collect precise geolocation data;
  • Support Data, which includes information you as part of your requests for customer support or technical support. Support Data includes attachments (e.g., reports and screenshots) that you provide as part of your support requests.
  • Communications Data, which includes your communications preferences (including your preferences in receiving marketing communications from us and our third-party partners), and information you provide when communicating or interacting with us, including via emails, texts, phone calls, fax, AI chatbots, feedback, posts, comments, or through in-person meetings. We may also keep a record of your communications with us and other information you disclose during the course of such communications (which may be stored as an audio file, video recording, or transcript).

For Authorized Users who are invited to join a Customer Instance, or who create an account to use our Services, we also collect, receive, and process the following types of Personal Data:

  • Account Data. To allow you access to a Customer Instance, and to allow you to use our Services, we collect (i) login information (e.g., username or user ID, business email address, domain, relationship to Customer), (ii) authentication information, such as passwords, single-sign-on information, multifactor authentication methods, etc. configured or selected by Customer and/or Authorized User, and (iii) profile and preference data (e.g., region/country of use, language preferences, notification preferences, complaints, and feedback). 
  • Service Data. We collect information about the performance and configuration of our Services and your use of and interaction with our Services, including usage telemetry (e.g., features used, search terms entered, and commands executed) and events data (e.g., clicks, views, invocations, permission changes, and scheduling triggers) (“Service Data”). While most Service Data is not Personal Data, it may include limited Account Data (e.g., User ID), Technical Data (e.g., IP address), and some statistical information relating to your use of and behavior within the Services. 

We may also collect, use, and share aggregated data such as statistical or demographic data which is not personal data as it does not directly (or indirectly) reveal your identity. For example, we may aggregate Usage Data or Service Data in order to analyze general trends in how users are interacting with our Sites and Services to help improve our Sites and Services.

2.2 Sources of Personal Data.

(a) From you.

  • Information provided by you: We collect Personal Data from you, when you (i) use our Sites or interact with us, including by submitting inquiries, requesting information about our Services, completing online forms or surveys, requesting or downloading Sigma materials (e.g., white papers, reports, etc.), interact with our AI Chatbots, register for our Events or marketing activities, subscribe to our newsletters or emails or give us feedback; (ii) register an account with us, to use our Services and/or join a Customer Instance; and (iii) choose to provide us with your Personal Data voluntarily, including by posting on public forums like Sigma Community.
  • Information Collected automatically. We automatically collect (i) Technical Data about your equipment, browsing actions, and patterns when you interact with our Sites; (ii) Service Data when you use our Services.

(b) From Third Parties.

  • Customers: We may receive Personal Data about you from Customers to invite you to their Instance and allow you to use the Services as the Customer’s Authorized User.
  • Partners and Public Sources: We may receive Personal Data about you from our third-party partners (e.g., resellers, distributors, business partners, and service providers) and from publicly available sources (e.g., social media platforms and public forums). Such Personal Data may include (i) business contact information, (ii) information about your purchases, support requests, and interactions with our Services and Sites, (iii) information regarding co-branded or private-labeled websites that offer their products and/or services on our Sites, and (iv) search results and links, including paid listings (e.g., sponsored links).
  • Advertising and Analytics Partners: We may use third-party service providers to serve ads about our Services on other websites. These third parties may automatically collect and use information about your online activities, either on our Sites or other websites, including by using Cookies or other similar tracking technologies. This Privacy Notice does not apply to, and we are not responsible for, Cookies and Beacons in ads delivered by third parties on other websites. Please check the privacy notices of ad services to learn about their use of cookies and other online tracking technologies. We also receive Technical Data about you from analytics providers like Google Analytics to help us analyze your use of our Site and diagnose technical issues. Please see Google’s Data Privacy and Security Policy. You may decide to withdraw your consent to such data collection by installing Google Analytics Opt-out Browser Add-on.

(c) Through our use of automated technologies.

  • Cookies. Our Sites use cookies and other similar technologies (“Cookies”) to function effectively. We (or an authorized third party) automatically collect and store Technical Data through Cookies that may uniquely identify your browser, computer and/or device. You can control our use of Cookies by adjusting your browser settings or clicking on “Cookie Settings” at the bottom of our Sites to modify your Cookie preferences. We also may collect information about your online activities on third-party websites over time or across devices and other online features and services. For more information about our use of Cookies, please review our Cookie Notice.
  • Beacons. Our Sites and communications from us (e.g., emails) may use web beacons, tags, and pixels (“Beacons”) to collect information about your internet, device activity, about how you use our Sites and interact with our communications. For example, we may place a pixel in our emails that notifies us when you click on a link in the email. We use Beacons to count users who have visited certain pages of our Sites, or have interacted with our Sites or communications, to deliver branded Services, to provide online advertising, to help determine the effectiveness of marketing or advertising campaigns to respond to your queries, communicate with you, and improve our communications Sites, and Services.

We may also combine information we have collected about you by the methods described above or in other contexts for our marketing and promotional purposes, such as to help us better determine what products, services and/or Events might be of interest to you.

3. Our Uses of Personal Data

We use and process your Personal Data to operate, maintain, provide, and improve our Sites, Services, and business, including for the following business purposes:

3.1 For providing, maintaining, and personalizing our Sites and Services, and providing you with support, including

  • To provide and facilitate the delivery of Services you request;
  • To provide you with technical support and customer support services;
  • To allow Customers to invite you to join a Customer’s Instance, allow you to accept such Customer invites, and to create, maintain, update, and manage your account and allow you to use the Services;
  • To identify you as an Authorized User in our systems, and provision relevant permissions to a Customers Instance; 
  • To detect bugs, report errors and perform activities to maintain the quality or safety of our Sites and Services;
  • To monitor and measure your use of our Sites and Services; and
  • To understand you and your preferences to enhance and personalize your experience and enjoyment when using our Sites and Services, including suggesting and offering you relevant content and recommendations.

3.2 For analyzing, developing, and improving our Sites and Services, including

  • To generate and analyze statistical information about how our Sites and Services are used in the aggregate;
  • To understand and analyze our user base and how you use our Sites and Services, and to improve and enhance the Sites and Services;
  • To develop new products, services, features, and functionality.

3.3 To communicate with you, including

  • To respond to your questions, comments, and requests, including to keep in contact with you regarding the Sites and Services you use; 
  • To send you notifications about the Services, including confirmations, training and support messages, technical notices, security alerts, administrative messages and invoices; 
  • To provide you with information that you request, respond to your comments and questions, and otherwise communicate with you, including through our AI chatbots;
  • To provide you with information regarding updates to our Services, Sites, Privacy Notice, or terms;
  • To send you a welcome e-mail to verify ownership of the e-mail address provided when your account was created;
  • To contact you to conduct surveys, receive your feedback, and conduct audits; and

3.4 For marketing, sales, and advertising purposes, including

  • To develop and send you direct and online advertising, sales, marketing, and promotional communications (e.g., alerts, notifications, emails and text messages, about Sites, Events, offers etc.) and to measure and understand the effectiveness of our marketing;
  • To show you ads (including targeted ads or cross context behavioral ads), including on third-party platforms and websites, and other mobile apps, platforms and/or devices;
  • To measure engagement with advertisements and marketing campaigns across different devices and websites, including to measure and understand the reach, viewership, and effectiveness of advertising, marketing, and promotional campaigns, and generate advertising analytics and reporting;
  • To create and provide sales and marketing training, including by analyzing sales calls using analytics tools to better understand interactions with customers. 

3.5 For legal and compliance purposes, including

  • To comply with and monitor our compliance with contractual and legal obligations;
  • To protect, investigate, and deter against fraudulent, unauthorized, infringing or illegal activity, including click fraud;
  • To comply with lawful requests and legal process, such as responding to subpoenas or requests from government authorities; 
  • To enforce the terms and conditions of our agreements, including with you and our Customers, or our other terms and conditions, or to protect our business, partners, or users. 
  • To enforce our legal rights and obligations, and for any purposes in connection with any legal claims made by, against or otherwise involving you; and
  • To protect and enforce the rights and property of Sigma, its customers, Vendors, users, employees or the public as required or permitted by applicable laws. 

3.6 To prevent illegal activity or unauthorized use of our Sites and Services, and to secure our Sites, Services, and systems, including 

  • To enhance security, monitor and verify identity or service access, combat fraud, spam, malware or other network and/or information security risks; 
  • To maintain and monitor the security of Sites, Services, Sigma premises, and Sigma’s systems, applications, and networks, including to investigate and prevent suspicious activity; 
  • To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted Personal Data; 
  • To identify and address malicious, deceptive, fraudulent, or illegal actions; 
  • To maintain the safety, integrity, and security of Sigma, its employees and other members of staff, and others as required or permitted by applicable laws

3.7 For business analytics, training, operational, and reporting purposes, including 

  • To conduct or participate in audits, investigations, mergers and acquisitions, or as required for maintaining business operational and reporting documentation; 
  • To measure performance and analyze key metrics relevant to our business; and
  • To conduct surveys, research, benchmarking, analysis, feedback collection and assessment, on our Sites, Services, and business activities, and improve and enhance our Sites, Services, and business activities.

We will also use your Personal Data for other purposes, where you have given consent for such uses.

4. Disclosure of Personal Data

We disclose your Personal Data as described in this Section 4 and as described elsewhere in this Privacy Notice. 

4.1 Affiliates.

We may disclose your Personal Data to our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Notice. 

4.2 Service Providers.

We may disclose your Personal Data to third-party service providers in order for those providers to perform business functions on behalf of Sigma, including as required to maintain, secure, manage, and operate our Sites and Services (“Service Providers”). 

4.3 Business Partners.

We may share your Personal Data with third-party business partners and sponsors, such as resellers and/or referral partners (“Business Partners”) who are involved in providing content or services to our prospects or customers. Business Partners include (i) third-party advertising and marketing partners that deliver advertisements and marketing campaigns about Sigma, our Sites, and Services to you, including advertising partners that utilize cookies and other tracking technologies in order to deliver advertisements (“Advertising and Marketing Partners”), and (ii) Business Partners who are working with us to organize or sponsor an Event (“Event Partners”) to which you have registered, including to enable them to contact you about the Event or their services. Please note that our Event Partners are responsible for managing their own use of the Personal Data they collect in these circumstances.

4.4 Legal compliance.

We may disclose your Personal Data to comply with our legal obligations, respond to a court order, adhere to administrative or judicial processes (such as a subpoena, government audit, or search warrant), or respond to lawful requests by public authorities (such as national security or law enforcement). 

4.5 Corporate Restructuring.

We will disclose or transfer your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. We will inform any buyer that your Personal Data may only be used in accordance with this Privacy Notice. In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Notice. 

4.6 Social Networking Sites.

Our Site may enable you to post content to social networking sites (“SNS(s)”) (e.g., Facebook or X). If you choose to do this, we will provide information to such SNSs in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of SNSs and that it is your responsibility to review the terms and privacy policies of such third-party SNSs. We are not responsible or liable for the content, products, or services offered by SNSs, or your use of any such SNSs.

4.7 Legitimate and Vital Interests.

We may disclose your Personal Data where it is necessary for our legitimate interests, including, to establish, exercise or defend against potential, threatened or actual litigation, establish or defend our legal rights, and to investigate or assist in preventing any violation or potential violation of applicable law or our recruitment and hiring policies. We may also disclose your Personal Data where necessary to protect your vital interests or the vital interests of another person. 

4.8 Other Disclosures.

We may disclose your Personal Data to fulfill the purpose for which you provide it; for any other purpose disclosed by us when you provide it; or with your consent. 

When we disclose your Personal Data to third-parties who perform processing activities for or on behalf of Sigma, including Service Providers and Affiliates we require them to abide by contractual, technical, and organizational measures that address the safeguarding and proper use of your Personal Data, and ensure that your Personal Data is processed only to the extent that such processing is necessary, consistent with this Privacy Notice, and in accordance with applicable law.

Further, we may disclose or use aggregated or de-identified information or data for any purpose. For example, we may share aggregated or de-identified information with prospects or partners for business or research.

5. Your Privacy Rights.

5.1 Your Rights.

Depending on where you are located and/or your residency, you may have some or all of the rights with respect to your Personal Data (as further described in the Supplemental Notices):

  • Right to know (and/or access) what Personal Data we have collected about you, including access to duplicates of the Personal Data retained;
  • Right to seek confirmation that we are processing your Personal Data;
  • Right to correct your Personal Data if it is inaccurate, outdated, or incomplete;
  • Right to request deletion of Personal Data that we have collected from you. 
  • Please note that we may have an overriding lawful basis for retaining your Personal Data (e.g., we may have to retain your Personal Data pursuant to our legal obligations) and accordingly may not be able to fully comply with your request;
  • Right to limit the processing, use, or disclosure of your sensitive Personal Data; 
  • Right to withdraw consent, at any time, where we have relied on your consent to process Personal Data; 
  • Please note that withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent
  • Right to request suspension of processing your Personal Data in certain circumstances, including when you believe that the Personal Data, we hold about you is inaccurate or unlawful;
  • Right to limit (and/or restrict) the processing, use, or disclosure of your sensitive Personal Data, if we process your sensitive Personal Data;
  • Right to opt-out of sale, sharing, targeted advertising, profiling or cross-context behavioral advertising, (as further described in Section 6.3 of this Privacy Notice);
  • Right to Data Portability, which means that you may request for your Personal Data to be transferred in a readable and standardized format; and
  • Right to appeal our decisions related to your privacy request.

5.2 Exercising Your Rights.

5.3 Our Obligations.

We value your privacy and will not discriminate in response to your exercise of your privacy rights. We will take commercially reasonable efforts to confirm receipt of your request within 10 business days and will respond to your request within 30 to 45 calendar days (subject to the applicable privacy laws in your region, and after requisite verification), unless we need additional time, in which case we will let you know. We may charge you a reasonable fee in instances that require a disproportionate effort, but we will advise you of any fee in advance. We may decline to process requests that are frivolous, unreasonably repetitive or burdensome, risk the privacy or impact the rights of others, or are extremely impractical.

5.4 Verification.

We may request certain information about you or your interactions with Sigma to verify your identity before we can respond to your requests to exercise your rights. This is done to protect your privacy and maintain security. We may require you to verify your name, region/country, location, email address, home address, and/or phone number in our records and provide information about your prior applications with Sigma (such as roles and positions for which you previously applied).  In certain limited circumstances, we may require you to sign a declaration under penalty of perjury that you are the individual whose Personal Data is the subject of the request.

5.5 Agent Requests.

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf or must demonstrate they have power of attorney pursuant to applicable probate law. Sigma retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity. An authorized agent is prohibited from using your Personal Data, or any information collected from or about you, for any purpose other than to fulfill your requests, for verification, or for fraud prevention.

6. Your Choices and Controls

We offer you certain controls and choices regarding the collection, use, and disclosure of your Personal Data, and we will respect the choices you make in accordance with applicable law. Please note that if you decide not to provide us with certain Personal Data (or limit our use of certain Personal Data), it may impact your use of the Sites and/or Services, and you may not be able to access certain features of the Sites and/or the Services.

6.1 Account Data.

All Authorized Users may review, update, correct or delete the Personal Data associated with their accounts on the Services (i) through the settings in our Services, or (ii) by submitting a support request, or (iii) by exercising your privacy rights in accordance with Section 5 and filling this form or emailing us at privacy@sigmacomputing.com. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your request and limited Personal Data for our records, if and as required (or permitted) by applicable laws or for our legitimate business purposes.

6.2 Opt-Out of Marketing.

We may periodically send you marketing related communications that promote our Services, consistent with your choices. If you no longer want to receive marketing-related communications (e.g., emails) from us, you may opt-out via the unsubscribe link (or unsubscribe instructions) included in such communications, or by filling this form. We will comply with your request(s) as soon as reasonably practicable. Please note that opting out of marketing does not opt you out of receiving important service, relationship, or business related communications, including communications about your use of the Services, your account on the Services, Site or Service announcements, security and updates related information, or other administrative messages that are required to provide you with the Site and Services.

6.3 Opt-Out of Sale, Sharing, and Targeted Advertising.

The terms “sale”, “sharing”, “targeted advertising”, and/or “cross-context behavioral advertising” (as defined applicable laws, including the state privacy laws of California, Connecticut, Colorado, Utah, and Virginia) may include the disclosure of your Personal Data (including your email address, phone number, device and usage data,) to Sigma’s Advertising and Marketing Partners, we provide the right to opt out of these activities. Depending on your location, you may have the right to opt out of the “sharing” or “sale” of your Personal Data or the processing of your Personal Data for purposes of online “targeted advertising” (or “cross-context behavioral advertising”). This means that, if you opt out, going forward, we will not disclose your Personal Data to third parties (including Advertising and Marketing Partners) for the purposes of online analytics, targeted advertising, or cross-context behavioral advertising, unless you later direct us to do so.

  • As further explained in our Cookie Notice, you may opt out of cookie and similar technologies based sale, sharing, or targeted advertising based by (i) visiting our “Cookie Settings” link on the footer of our Sites, and disabling optional cookies, or (ii) by enabling a legally-recognized browser-based opt-out preference signals that are turned on via your device browser, such as the Global Privacy Control. You may opt out of email or phone number based sale, sharing, and targeted advertising by filling out this form, and indicating your intent to opt-out.

7. International Users and Data Transfers.

7.1 International Transfers.

Sigma’s global organizational structure requires the transfer of Personal Data to Sigma’s Affiliates, Service Providers and other third parties as described in Section 4 of this Privacy Notice. Accordingly, your Personal Data may be transferred to, and processed in, countries other than the country where it was provided or where you are located. In particular, we may transfer your Personal Data to the United States of America, and other countries where our Affiliates, and Service Providers are located. These countries may have data protection laws that are different to the laws of the country where you are located or residing. Sigma will ensure that appropriate or suitable safeguards are in place to protect the transferred Personal Data and that transfer is in compliance with applicable data protection laws. These safeguards include implementing the European Commission’s Standard Contractual Clauses (and/or the UK International Data Transfer Addendum, if applicable), or other equivalent and lawful mechanisms that are approved by applicable regulators or legislators for transfers of Personal Data from other global jurisdictions with similar transfer requirements. 

7.2 DPF Notice.

Sigma Computing Inc. has also self-certified compliance with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK extension to the EU-U.S. Data Privacy Framework (“UK Extension”), and the Swiss-U.S. Data Privacy Framework set forth by the U.S. Department of Commerce (“Swiss-U.S. DPF” and collectively, the “DPF”). Sigma has certified to the U.S. Department of Commerce that it adheres to (i) the EU-U.S. DPF Principles with regard to the processing of Personal Data received from the EU in reliance on the EU-U.S. DPF, (ii) the UK Extension with regard to the processing of Personal Data received from UK (and Gibraltar) in reliance on the UK Extension, and (iii) the Swiss-U.S. DPF Principles with regard to the processing of Personal Data received from Switzerland in reliance on the Swiss-U.S. DPF (collectively, the “DPF Principles”).  If there is any conflict between the terms in the Privacy Notice and the DPF Principles, the DPF Principles shall govern. 7.3 Information for Individuals in EU, UK, and Switzerland.

If you are located in EU, UK, or Switzerland, please review our Supplemental Notice for EU, UK and Swiss Individuals regarding additional information on how we process your Personal Data, and any additional rights you may have.

8. Data Retention.

We retain your Personal Data only so long as reasonably necessary to fulfill the legitimate business purposes for which it was collected (as described in Section 3), or as otherwise required or permitted by law (for example, to comply with our legal and compliance requirements). We securely delete or anonymize your Personal Data, when retention of such Personal Data is no longer reasonably necessary for our legitimate business purposes. If such deletion or anonymizations is not possible (e.g., because your Personal Data has been stored in backup archives), we will securely store your Personal Data and isolate it from any further processing until deletion or anonymization is possible.

We will take commercially reasonable efforts to comply with your reasonable requests, and where we cannot comply with your requests, we will provide you with our reasons for such non-compliance without unreasonable and undue delay.

9. Storage, Access, and Security.

We have implemented reasonable technical and organizational measures designed to provide industry standard security appropriate to the risk, in our effort to protect your Personal Data against unauthorized, accidental, or unlawful access, destruction, loss, alteration, disclosure or use. These measures have been implemented taking into account the state of the art of the technology, the cost of implementation, the risks presented by the processing, and the nature of Personal Data. However, since no security measures are perfect, impenetrable, or 100% secure, we cannot guarantee the security of your Personal Data.

Access to your Personal Data is restricted to those individuals who need such access for the purposes listed in Section 3. All Sigma personnel who are permitted to access Personal Data are bound by and required to abide by contractual, technical, and organizational measures that address the safeguarding and proper use of your Personal Data and are also regularly provided with privacy related training.

10. Use by Children

Our Sites and Services are intended for adults and is not directed at individuals under the age of 18.  We do not knowingly collect Personal Data from anyone under the age of 18. If a parent or guardian becomes aware that their minor child has provided us with Personal Data without their consent, they should contact Sigma through Sigma’s Privacy Request Form or by emailing us at privacy@sigmacomputing.com. We will delete such Personal Data of minors within a commercially reasonable time.

Our Site may contain links to third-party websites, applications, and services (“Third Party Websites”). When you click on a link to a Third Party Website, you will leave our Sites and go to another website, and the collection, use, and processing of your Personal Data will be governed by the Third Party Website’s terms and privacy notices. We have no control over, do not review, and are not responsible for the privacy practices of Third Party Websites. Please be aware that the terms of this Privacy Notice do not apply to the collection and use of your Personal Data by Third Party Websites. We encourage you to read the terms and privacy policies of every Third Party Website that you visit. 12. Notice to Authorized Users.

12.1 Customer Controls.

Our Services are intended to be used by organizations (the Customer). Where the Services are made available to you by or through a Customer (e.g., your employer), that Customer controls your access and use of the Services (including the Customer Instance and all Customer Data), and is responsible for configuring permissions, roles, and rights for your account. For example, the Customer (including any Customer personnel who have been given administrator role and privileges by the Customer) can access and change information in your account or restrict and terminate your access to the Services, a Customer Instance, or Customer Data. We are not responsible for the privacy or security practices of the Customer organizations, which may be different from the practices reflected in this Privacy Notice. Please contact the Customer or refer to the Customer’s policies for more information on their privacy and security practices. 

12.2 Exercising Your Privacy Rights in Customer Data.

If Personal Data pertaining to you as an individual has been submitted to the Services by or on behalf of a Customer (i.e., as part of Customer Data) and you wish to exercise any privacy or data protection related rights you may have under applicable law, with respect to such Personal Data, please reach out to the relevant Customer directly and refer to that Customer's privacy related policies and notices.

13. Changes to This Privacy Notice.

We reserve the right to change this Privacy Notice at any time. The “Last Updated” heading in this Privacy Notice indicates when it was last revised. Any changes will be posted on this page with an updated revision date. It is your responsibility to periodically review this Privacy Notice to remain informed about our collection, processing and sharing of your Personal Data. We may, in our sole discretion, provide you communications, including via email, about changes to our Privacy Notice; however, such communications do not abrogate or otherwise limit your responsibility to periodically review the Privacy Notice to determine whether any amendments have been made hereto.
