AI CHATBOT TERMS OF SERVICE

These AI Chatbot Terms of Service ("Terms") are a binding agreement between you and Sigma Computing, Inc. and its affiliates (collectively, "Sigma," "we," "us" or "our"). In these Terms the words "you" and "your" refer to each person or entity that interacts with or uses the artificial intelligence ("AI") powered chatbots ("Chatbot(s)") on Sigma’s websites, including help.sigmacomputing.com (the "Sites"), and within Sigma’s cloud-based intelligence tool (the "Sigma Platform").

BY INTERACTING WITH, OR OTHERWISE USING THE CHATBOTS, YOU REPRESENT THAT: (I) YOU HAVE READ, UNDERSTAND AND AGREE TO THESE TERMS, (II) YOU ARE NOT A MINOR, AND (III) YOU HAVE THE AUTHORITY TO ENTER INTO THESE TERMS PERSONALLY OR ON BEHALF OF THE ENTITY YOU REPRESENT. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, DO NOT INTERACT WITH OR USE THE CHATBOT.

These Terms do not apply to your use of Sigma’s products (including the Sigma Platform), services, and support services, which are subject to separately executed agreements between Sigma and our customers.

1. Use and Ownership.

Our Chatbots may be powered by third-party AI providers, including Intercom’s FinAI. When you ask questions or submit information to the Chatbot ("Chat Input"), the Chatbot will generate results ("Chat Output") in response to your Chat Input based on publicly available Sigma Documentation, Sigma Community posts, and Sigma Quickstarts ("Sigma Materials"). You own all Chat Input and hereby grant Sigma the right to use, store, transfer, reproduce, modify, display, and distribute your Chat Input for the purposes of (i) generating and displaying Chat Output, (ii) providing, maintaining, and improving the Sigma’s products, services, and support services, and (ii) complying with applicable laws. Sigma and its licensors own all Sigma Materials and the Chatbot, including all contents, features, and functionalities thereof.

2. Privacy and Confidentiality.

You are solely responsible for the selection and accuracy of Chat Input. You agree that you will not include any confidential information, personal information, or sensitive information in Chat Input. Sigma will treat all Chat Input as non-confidential and non-proprietary in nature. If you provide or share any personal information with the Chatbot, you agree to your personal information being processed in accordance with Sigma’s Privacy Policy.

3. Acceptable Use.

You are prohibited from using the Chatbot (i) in a manner that violates any applicable federal, state, local, or international law or regulation; (ii)  to distribute, display, publish, republish, process, modify, or copy any Sigma Materials or Chat Output; (iii) for any commercial purposes. You are further prohibited from using automated tools or scraping software to access or interact with the Chatbot.

4. Limitations and Accuracy.

Use of the Chatbot is optional and at your sole discretion. By using or interacting with the Chatbot, you agree and acknowledge that:

  • The Chatbot and Chat Output are provided solely for informational and reference purposes, and are not intended to be a substitute for Sigma’s support personnel.
  • Chat Output generated for you may not be unique and is not considered a custom deliverable. Third parties may submit questions or information to the Chatbot that generate results that are identical or similar to Chat Output generated for you.
  • Sigma cannot guarantee the accuracy, completeness, or currentness of  Chat Output.  The Chatbot and Chatbot Output are provided "AS IS," without warranty or indemnity of any kind.
  • Chat Output should not be relied on without independently evaluating its accuracy and appropriateness.

5. Limitation of Liability.

SIGMA IS NOT LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY TYPE WHATSOEVER RELATED TO OR ARISING FROM THE CHATBOT OR YOUR USE OF THE CHATBOT. THIS EXCLUSION APPLIES TO ALL CAUSES OF ACTION, NO MATTER THE LEGAL THEORIES, AND WILL APPLY TO THE FULLEST EXTENT PERMISSIBLE BY LAW AND REGARDLESS OF WHETHER ANY REMEDIES IN THESE TERMS FAIL OF THEIR ESSENTIAL PURPOSE. YOUR SOLE AND EXCLUSIVE REMEDY HEREUNDER SHALL BE FOR YOU TO DISCONTINUE YOUR USE OF THE CHATBOT. IN THE EVENT THAT THIS LIMITATION IS SUPERSEDED BY APPLICABLE LAW, THE MAXIMUM AMOUNT OF DAMAGES YOU MAY OBTAIN AGAINST SIGMA SHALL BE LIMITED TO $100.00 USD.

6. Miscellaneous.

Sigma reserves (i) all rights and titles not expressly granted under these Terms, and (ii) the right to stop providing or to modify the Chatbot at any time and without notice.  It is your responsibility to review these Terms periodically, and Sigma may revise these Terms at any time, without notice to you, by posting a new version of these Terms here. These Terms are governed by the laws of California, without regard to its conflict of laws rules. You expressly agree that the exclusive jurisdiction for any claim or dispute under these Terms will be in the courts located in San Francisco, California. If a particular provision in these Terms is not enforceable, that will not affect any other provisions.
